Judge Allows Rothstein-Related Civil Trial To Continue

A federal judge today rejected TD Bank’s efforts for a mistrial and directed verdict in the first trial stemming from ex-lawyer Scott Rothstein’s $1.2 billion Ponzi scheme.

U.S. District Judge Marcia Cooke in Miami ruled the trial of the lawsuit brought by Corpus Christi, Texas-based Coquina Investments can go forward after a holiday break. Coquina is expected to ask for $100 million from TD Bank, which is accused of being in cahoots with Rothstein in his settlement financing scheme.

Rothstein is serving a 50-year prison term.

WEST PALM BEACH — A jury on Wednesday awarded $28.8 million to the brother-in-law of the king of Jordan in a dispute with Gulf Stream billionaire Harry Sargeant over a multi-billion-dollar U.S. defense contract to provide fuel to troops in Iraq.

WITNESS PREPARATION

An unprepared or under-prepared witness can be vulnerable to a skillful questioner or a rigorous cross-examination. When a witness does not present well before a jury, the content of the story he tells is diminished by the way he tells it. On the other hand, a well-prepared, confident witness can impart critical case themes to a jury. With clarity and confidence, he can effectively thwart a difficult cross-examination.

Each of our witness coaching sessions is tailored to specific case and client needs. We first work diligently to learn the key issues and themes of the case, and understand how the witness’s story ties in with those themes. Part of the training provided deals with the basics of understanding the needs, requirements, and expectations of a jury. We show the witness how to tie his story into the overall theme of the case, and coach the witness on reinforcing those themes in testimony. We demonstrate the most effective way to deliver the message to the jury by coaching the witness on the best way to present, as well as defend his position.

We bring video recording and playback equipment to assist in recording and reviewing the witness coaching and preparation session. Using questions developed by the attorney for both direct and cross-examination, the witness is questioned, much the way he might be questioned in court. We then use the video to review body language and intonation, allowing the witness to see himself through the eyes of a juror, and understand and correct subconscious messages he may be sending through physical and verbal phrasing.

Our goal is to help the witness feel comfortable and confident in difficult and intimidating situations such as a courtroom, to show him how to use body language and verbal phrasing to promote his credibility, and ultimately to give our clients confidence in the witness’s ability to testify.
